1. Scope of Application

These Terms and Conditions apply to the use of the mobile application “Don’t Guess,” provided by don´t guess GmbH (hereinafter referred to as the “Provider”). By installing and using the app, you acknowledge these Terms and Conditions as binding.

3. Leistungsbeschreibung 

The “Don’t Guess” app enables users to capture moments from their everyday lives, particularly within relationship contexts. Users can collect so-called green and red spheres, optionally with notes, and share them with a connected partner profile.

In addition, supplementary features such as weekly overviews, journal entries, or other reflection tools may be provided.

Access to certain features requires a paid subscription.

New users receive a one-time 14-day free trial,if offered through the Apple App Store or Google Play Store. During this trial period, all features included in the selected subscription plan are fully available.

The available features, prices, and payment terms are determined by the information displayed within the app and any additional terms applicable to paid content.

There is no entitlement to any specific scope of features; the provider may further develop, expand, modify, or remove features of the app at any time.

4. Registration & User Account

Using the app requires registration with an email address and password. Users agree to provide truthful information and to keep their login credentials confidential.

The Provider reserves the right to suspend or delete user accounts in cases of misuse.

5. Data Security and Encryption

The “Don’t Guess” app uses end-to-end encryption to best protect user privacy.

The security key required to decrypt content is generated and stored exclusively on the user’s device. The Provider has no access to this key and cannot recover or replace it..

Users are responsible for securely storing and regularly backing up their personal key and login credentials.

If the key, login credentials, or both are lost, access to stored content will no longer be possible.The Provider cannot restore the account or recover any data..

The provider assumes no liability for data loss caused by forgotten or lost login credentials.

6. Content & User Conduct

Users are solely responsible for any content they upload to the app. It is prohibited to upload unlawful, offensive, discriminatory, or otherwise inappropriate content.

The Provider reserves the right to review and remove content in the event of violations.

7. Availability & Modifications

The provider strives to ensure the smooth operation of the app and its features. However, there is no entitlement to continuous availability or complete freedom from errors.

The provider reserves the right to further develop, modify, or discontinue the app or individual features at any time. Such adjustments may be made in particular to improve the user experience, for technical reasons, or to comply with legal requirements.

8. Liability

The Provider is fully liable for intent and gross negligence.
In cases of slight negligence involving the breach of essential contractual obligations (cardinal obligations), liability is limited to foreseeable damages typical for such contracts.

Any further liability is excluded.

10. Term & Termination

The usage agreement is concluded for an indefinite period and may be terminated by either party at any time without stating a reason.
Users can delete their account at any time directly within the app settings.

11. Subscriptions, Trial Period & Payment Terms

Certain features of the “Don’t Guess” app are only available as part of a paid subscription.

New users receive a one-time 14-day free trial,.

The trial period begins when a subscription is initially activated via the respective app store (Apple App Store or Google Play Store).

During the trial period, the full range of features included in the selected subscription is available.

The trial period automatically ends after 14 days and converts into a paid subscription unless it is cancelled beforehand in the respective store.

Cancellation can be made at any time during the trial period through the user’s app-store account.

Subscriptions are concluded through the respective app store and billed exclusively by the store provider.

A subscription automatically renews for the selected term unless cancelled before the end of the current billing period.

In the event of a price change, users will be notified in advance by the respective store.

f the new price is not accepted, the subscription may be cancelled in the store before the change takes effect.
